NAFTA has been considered a "green trade agreement" because it addresses environmental concerns within its charter. It was ratified with an environmental side agreement, the North American Agreement on Environmental Cooperation (NAAEC). The NAAEC was negotiated and signed on September 13, 2003 and went into force on January 1, 1994. The preamble of the NAAEC makes reference to protecting the environment, including the promotion of sustainable development and the need to protect and strengthen environmental laws [26]. The NAAEC promotes open access and transparency to information regarding each NAFTA country's pollution emissions and their strategies for effective environmental policy. Article 14 of the NAAEC provides a procedural mechanism and process for the submission of complaints towards the intent of the NAAEC. Under article 14 any person or NGO residing within the NAFTA trading bloc can file a submission, asserting that any one of the signatory parties to NAFTA is insufficiently upholding its environmental laws according to the NAAEC agreement. An investigation of the complaint is then conducted. There is a strong argument for the effectiveness of this process due to its transparent nature [27].
